XP Card Technologies Ltd is not a bank but an official contractual partner of Advanzia Bank SA, a fully licensed and regulated financial institution authorized by the Luxembourg Commission de Surveillance du Secteur Financier (CSSF). XP Card Technologies Ltd does not provide banking, lending, or credit decision-making services. Rewards and Premium Memberships distributed by XP Card are marketing and promotional services only, not financial products.

XP Card Technologies Ltd provides marketing and membership services across the European Union in full compliance with local regulations. It does not provide financial advice or otherwise regulated services and operates solely as an agent in the respective markets for Advanzia Bank SA.

1. Scope of Card, Points & Rewards

XP Card operates a free tier loyalty program with a XP Card branded credit card, where users can collect points from using the XP Card branded credit card. Each transaction generates points into the cardholders XP Card account. These points can be redeemed inside the app hosted and operated by XP Card.  

The general rewards may include:
- Gaming reward codes (e.g., Steam, PlayStation, Xbox)
- Bonus random drops (e.g., in-game skins, loot)
- Access to partner or brand deals (e.g., bonus XP for partner purchases)

Disclaimer:
- XP Card does not sell these rewards individually and cannot guarantee availability outside of a promotion or membership package.
- XP Card does not sell points to its users
- XP Card is not a wallet
- XP Card does not operate or provide the purchasing or storing of value on its platform


2. Premium Membership

The Premium Membership "Pro Level" and "Elite Level" is each a paid bundle providing additional benefits to its members with higher point accumulation, guaranteed rewards and bonus benefits. It includes:
- increased point accumulation from card-usage compared to the free tier
- physical non-transferable event tickets
- guaranteed bonus random drops (e.g., non-transferable skins for social actions), these are not lotteries or raffles
- limited restricted gaming platform rewards accessible only over time
- Access to exclusive brand deals (e.g., bonus XP for instore or online partner purchases)

Membership Price & Payment: Pro Level is €69.99 and Elite Level is 189.99 per year. Payment confirms acceptance of these Terms & Conditions.

Delivery of Premium Rewards: Guaranteed rewards are not available right at purchase, but only accessible after certain time-periods after request and after card- and membership-activation to reduce fraud and chargeback risk. Bonus rewards are delivered according to user actions or partner rules. All rewards are non-transferable and cannot be redeemed for cash.

3. User Eligibility
Rewards and Premium Membership are available only to registered XP Card users who comply with platform rules. XP Card may deny or revoke rewards or membership for:
- Fraudulent behavior or misuse of the platform
- Account sharing or hacking
- Offensive, discriminatory, or abusive language
- Failed KYC verification, if applicable

4. Payments & Fraud Prevention
- Payments must be made via offered payment methods.
- XP Card reserves the right to delay reward delivery if suspicious account activity is detected.
- Memberships may be terminated for any of the reasons above.
- Premium Memberships are structured as bundles: payment is for the membership, not for individual rewards.

5. Right of Withdrawal / Cancellation
Premium Memberships can be cancelled within the statutory withdrawal period. Once codes, tickets, or bonus rewards are delivered or activated, they cannot be returned or refunded. XP Card will refund any unused membership fees within 14 days.

6. Use of Rewards
Rewards are intended for personal use only. Users may not sell, trade, or exchange rewards for cash or other financial value. XP Card is not liable for issues arising from third-party platforms, including game servers or partner services.

7. Liability
XP Card is responsible only for rewards and services under its control. XP Card does not guarantee the value, availability, or functionality of third-party rewards.

8. Intellectual Property
All third-party company names, game titles, product names, brands, logos, trademarks, service marks, images, and other intellectual property referenced on the Platform are the property of their respective owners. Any references to third-party games, publishers, platforms, rewards, products, or services are provided solely for identification and descriptive purposes. XP Card Technologies Ltd. is not affiliated with, endorsed by, sponsored by, or officially associated with any third-party publisher, game developer, platform operator, or trademark owner unless explicitly stated otherwise. The availability of any gaming-related rewards, gift cards, or promotional items does not imply any direct partnership or endorsement by the respective rights holders. Any rewards, gift cards, or related products made available through the Platform are sourced through legitimate commercial vendors, distributors, or partners.

XP Card Technologies Ltd. respects the intellectual property rights of third parties. If any rights holder believes that content displayed on the Platform infringes their intellectual property rights, they may contact us at at the email below.Upon receipt of a sufficiently detailed notice, we may review and remove or modify the relevant content where appropriate according to European Union law.

8. Data Protection
User data is collected solely to process rewards and Premium Membership and to verify eligibility. All data is handled in accordance with applicable EU data protection regulations.

9. Governing Law & Jurisdiction
Cyprus law governs the agreement.The UN Convention on Contracts for the International Sale of Goods is excluded.
